Terms of Service

The terms governing access to and use of CommissionAPI.

Last updated: 20 September 2026

These terms are a binding agreement between you, or the company you represent (“you”, “Publisher”), and Sivi Quant Labs Private Limited, which operates CommissionAPI (“CommissionAPI”, “we”, “us”). By applying for access, receiving API credentials or using the service, you accept them. If you are accepting on behalf of a company, you confirm you are authorised to bind it.

1. The service

CommissionAPI is an interface through which approved performance programs can be discovered, promoted through tracked links, and reported on. We own the platform, its software, documentation and marks; nothing here transfers ownership to you. We grant you a non-exclusive, non-transferable, revocable right to access the service for your internal business purposes while these terms are in force.

CommissionAPI is pre-launch. Features described on this site as “coming soon”, “planned” or “developer preview” are not available. Preview interfaces may change or be withdrawn without notice, and must not be relied on for production systems.

2. API usage

You may call the API only through your own credentials, in line with the published documentation and any rate limits we set. You must not attempt to circumvent limits, probe or load-test the service without written permission, reverse engineer it, or use it to build a competing product. We may apply, change or enforce rate limits to protect service stability.

3. Account security

API keys are secrets. You are responsible for keeping them confidential, for all activity carried out under them, and for the conduct of anyone you allow to use your integration. Tell us immediately at developers@commissionapi.com if a key may have been exposed, and we will revoke and reissue it.

4. Acceptable use

You must not use CommissionAPI to do anything unlawful, deceptive or harmful. The prohibited practices set out on the Compliance page form part of these terms, and include fraudulent clicks, cookie stuffing, misleading advertising, unapproved paid search, unauthorised trademark bidding, spam, incentivised traffic where prohibited, fake leads, artificial calls, self-referrals where prohibited, and misrepresenting your relationship with an advertiser.

5. Publisher obligations

You must declare your properties and traffic sources accurately, keep those declarations current, and promote offers only through the channels a given program permits. You are responsible for complying with the law that applies to your promotion, including advertising disclosure rules such as the FTC Endorsement Guides, the UK CAP Code and equivalent regimes, and for the content of your own properties.

6. Third-party programs

Offers reachable through CommissionAPI originate with advertisers and affiliate networks that set their own terms. Those terms apply to you in addition to these, and where a program's terms are stricter, the stricter terms govern your promotion of that program. We are not a party to your relationship with an advertiser and do not control their decisions.

7. No guarantee of offer availability

Programs may be added, restricted, paused or withdrawn at any time by us, by a network or by an advertiser, with or without notice. We do not guarantee that any particular offer, category, geography or commission rate will be available, or that it will remain available. We provide the service on an “as is” and “as available” basis and, to the extent the law allows, exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

8. Commission calculation

Commission accrues only on conversions that the relevant advertiser or network records, validates and approves under that program's rules. Their measurement governs. Commissions are reported through the service with a status of pending, approved, rejected, reversed or payable. Amounts shown before approval are estimates, not a debt owed to you.

9. Reversals

Conversions may be reversed after approval — for chargebacks, cancellations, returns, duplicate or invalid leads, or a finding of policy breach. Reversed amounts are deducted from your balance, and if they exceed it, from future earnings. Where a reversal follows fraud on your side we may recover amounts already paid.

10. Fraud

We may investigate traffic and conversion patterns that suggest fraud or policy breach. During an investigation we may withhold affected commissions and suspend access. Where a breach is established we may withhold the disputed amounts permanently, terminate this agreement, and share relevant traffic information with affected providers and advertisers as permitted by our agreements and applicable law.

11. Program restrictions

Programs carry their own limits on geography, traffic source, brand-term bidding, coupon and incentive models, and creative use. These are enforced per program, not globally: a channel one advertiser permits is not permitted elsewhere by default. It is your responsibility to check a program's rules before promoting it.

12. Suspension and termination

You may stop using the service at any time. We may suspend or terminate your access if you breach these terms, if a provider or advertiser requires it, if required by law, or if we discontinue the service. Where circumstances allow, we will give notice and an opportunity to remedy. On termination, your right to use the service ends immediately; approved commissions properly earned before termination remain payable except where clause 10 applies. Clauses 1, 10, 13, 14, 15, 16 and 17 survive.

13. Intellectual property

We retain all rights in the platform, documentation, and the CommissionAPI name and marks. You retain all rights in your own content and properties. You may describe your integration factually; you may not use our marks in a way suggesting endorsement or partnership beyond the facts, and you must stop on request.

14. Liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, or for lost profits, revenue, data or goodwill, however caused. Our total aggregate liability arising out of or relating to these terms is limited to the greater of the commissions we paid you in the three months before the event giving rise to the claim, or one hundred US dollars. Nothing here excludes liability that cannot lawfully be excluded, including for fraud or death or personal injury caused by negligence.

15. Indemnification

You will indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your promotional methods or content, or your infringement of a third party's rights. We will indemnify you against third-party claims that the platform as provided by us infringes their intellectual property rights. The party seeking indemnity must notify the other promptly and allow it to control the defence.

16. Governing law and disputes

These terms are governed by the laws of India, without regard to conflict of laws rules. The courts of Bengaluru, Karnataka have exclusive jurisdiction, and both parties submit to it. Before filing, the parties will attempt in good faith to resolve the dispute by discussion for 30 days.

17. Changes and general

We may update these terms as the platform develops. Material changes will be notified to partners by email or in the service at least 30 days before they take effect, except where a change is required by law or to address a security or legal risk, in which case it takes effect immediately. Continuing to use the service after a change takes effect means you accept it.

If any provision is held unenforceable, the rest remains in force. A failure to enforce a right is not a waiver of it. You may not assign this agreement without our written consent; we may assign it to an affiliate or in connection with a merger or sale of assets. These terms, together with the Compliance page and the Privacy Policy, are the entire agreement between us on this subject.
